THINGS TO THINK ABOUT WHEN VOTING

How much, or how little, authority does your association board have in making decisions on behalf of the entire community? More than you might think. Most declarations allow the board to unilaterally decide who your managing agent or onsite staff members are, and what they are paid, who is retained for legal counsel, which vendors you use for landscaping, pool service, cleaning, security, concierge, tax prep, audits and most every other service provider for normal operations. Did you know that in most cases, they choose your gas provider, trash service provider and cable provider?! They have the authority to make decisions, as Eric mentioned, for safety reasons. State statutes 718-720 along with your association documents provide clear outlines as the just how far the boards authority extends. Think about Eric’s question regarding the fence, “Who’s going to pay for it?” The answer of course, is you the unit owner!! Does it disturb you that the board potentially put you individually in debt, without consulting you first? Has your board made questionable decisions regarding unbudgeted expenses?
