WHO IS RESPONSIBLE FOR REPORTING

Let’s say you are a Board member and you “suspect” one of the other Board members is getting kickbacks or helping themselves to association funds. What do you do? Nothing, sadly, without concrete proof!! You cannot make allegations of improprieties!

 

However, let’s say you’re a Board member or a licensed CAM and you have a Board member who is requesting checks be made payable to him so that he can pay his vendors, who have no business licenses and no insurance and they are unable to provide invoices for backup. The other Board members turn a blind eye, but the CAM asks the right questions and documents everything. Should the CAM report their suspicions to the DBPR if it appears that there is some fraudulent activity going on? What if it is just sloppy management and record keeping?

 

My opinion is you take steps to seek legal counsel’s advice. If the board is unwilling to investigate, then as a licensed CAM you need to let your employer know what is happening, so that they can guide you and make the best business decisions for you and your company. When things go bad, there is always finger pointing. So it may be wise to resign from the account as not to get caught up in the problems! Would you tell?
