THERE IS NO MEETING!!

No matter the Board, or the community they represent, they will at some time try to skirt the Florida Statute regarding meetings. I thought I would use this opportunity to see just how far some boards will go.

In a very large community, in south Florida, the Board was (as a group) doing things that maybe they should not have. A group of unit owners banned together asking my firm to consider taking over management as they were finalizing their recall efforts and wanted to hit the ground running. We were invited to meet with this group and give a proposal. Unbeknownst to us and the recall group, the Board along with current management, were having a meeting without posting a notice! At the advice of their management team, they set up three computers with conferencing. They placed one in the business center, where two Board Members were located, one in the Managers office with the Property Manager and one in the Billiards room with the remaining two Board Members. As they “simply chatted”, various Board Members would leave their area for 10 minutes or so. When the group pushing for the recall, began taking photos with their cellphones and questioning the Board Members as to why they were having a secret meeting. His response was priceless. “We are not having a board meeting.” “Did you see a meeting notice posted?” “Did you see quorum of the board in one area? There is no meeting!

Really?! You can’t make this stuff up!
