REPEATING MYSELF

At the risk of repeating myself, yet again, let me once again suggest that board members should rely on their legal counsel to advise them before executing any and all contracts. That being said, the board does need to do some due-diligence on the front end!

  1. Obtain competitive bids

  2. Call reference

  3. Google the chosen Contractor, Engineer and Law Firm

  4. Make sure you have written acknowledgement from all parties that no one has financial holdings on any firm being considered

  5. Instruct legal counsel to make sure all contracts have a not to exceed clause!

  6. Never, never, never sign an open ended contract. The associationís attorney should be looking out for your best interest.

To Ericís point, yes there should be a law. But, letís face it. The engineering firms and contractors will simply wine and dine legislators to ensure no such legislation passes.
