WHAT SHOULD THE BOARD CONSIDER WHEN IMPLEMENTING RULES AND REGULATIONS?

I happen to live in an HOA with very strict covenants. This is fine by me, I want my investment to be maximized. One covenant states, “No commercial vehicles may be parked on the property”! Having owned our home for twelve years, and my husband being a police officer with a take home patrol car, no one had ever complained or mentioned his patrol car was considered a commercial vehicle.

 

Fast forward, a new Board is elected. One of whom, had several run-ins with law enforcement. The Board decided to add a new Rule and Regulation stating that law enforcement vehicles were deemed to be commercial vehicles and thus prohibited him from parking in our driveway! We received notice that the vehicle was to be removed or it would be towed!

 

Needless to say, the entire neighborhood was up in arms! After all, who wouldn’t want a police presence in their neighborhood? Okay, well maybe not in today’s world, but years ago it was welcomed.

 

After much protest from the unit owners, the Board reversed their decision and removed the new Rule/Regulation. I would like to be able to say that we lived happily ever after. However, weeks later, the patrol car was egged and toilet papered!

 

Remember, when making Rules and Regulations, it has to be what is in the best interest of the community as a whole!
