Don’t Ask, Don’t Tell

Unfortunately, don’t ask, don’t tell is the approach many board members and homeowners take when they have strong suspicions that one or more board members are mishandling association funds. One clear case of this is a community in south Florida, who has made the local news several times due to unaccounted for funds. These amounts have been reported to exceed four million dollars! Several new board members were elected, after a successful recall, yet the board refuses to spend the money to have a forensic audit performed.

 

I recently received a call from one of these new board members requesting a proposal for management services, when asked if they had undergone legal counsels advice to have the forensic audit, the reply was “No, we decided just to move on”. Needless to say, my response was, thank you but we are not taking new clients at this time!

   

In my opinion, the failure of this board to take action, recommended by legal counsel to trace missing funds, makes them just as guilty as those who actually misappropriated the funds. You tell me… am I right or am I wrong? If people are not held accountable for their actions, the wrongful actions will never change. I say, forget “don’t ask, don’t tell”, but rather scream, kick, demand, call the DPBR, review financial statements and any other association records. Stand up for what is right, not what is easy!
