ARBITRATION AND MEDIATION: WHAT’S THE DIFFERENCE?

As a management firm, we have been extremely lucky to have only been involved in a few litigation cases in Florida. What I have learned is there seems to be confusion over what transpires at arbitration verses meditation. I admit, I was one of those who were confused, as well. So for those of you who need clarification, let me give it a try.

 

ARBITRATION

This procedure is very much like a court hearing. Each side will present their case, evidence and witnesses before the Arbitrator. The Arbitrator possesses the power to render the legal binding decision, which both parties must comply. The Arbitrators decision is enforceable in court.

 

MEDIATION

This process is less formal. The Mediator is an unbiased ear to listen to both parties and attempt to talk reason and compromise, so that the issue at hand does not end in litigation! A mediator cannot issue orders or make final legally binding decisions. Their purpose is to guide the parties into a mutually beneficial resolution. Most people find the process of mediation less costly, less stressful and less time consuming than arbitration.
