WHO IS RESPONSIBLE FOR CONSTRUCTION DEFECTS?

Most unit owners think it is the developer who is responsible for poor construction. However, maybe not when filing a construction effect claim, you quickly learn fingers get pointed in every direction. It is the unit owners fault, did they fail to maintain the property, and did they immediately address the issue to stop continued damage? Is it managements fault? Did they not notify the board and advise corrective action be taken? Is it the Boards fault? Did they fail to take immediate corrective action in accordance with Florida State statute and the Declaration? Now here is where it gets CRAZY. Is it the Developers fault? They immediately point fingers at the construction contractor who points fingers at the Sub-Contractors who points fingers at the Engineer, who points fingers at the Architect!!

 

Then the attorneys get involved and the fun continues! Just kidding about it being fun! The process drags on for years, and we all know the only one making money is the attorneys.
