ARE ASSOCIATIONS AND LCAMS CAUGHT IN THE MIDDLE?

Speaking purely from experience, HUD’s recent statement causes me great concern for various reasons. Let me present a scenario for consideration…..

 

Harmony Homeowners Association has amended documents stating “NO Convicted Felons, May Lease or Purchase a Home in the Community.” The board and CAM go the extra mile to ensure EVERYONE is vetted exactly the same, and makes NO exceptions. HUD issues their statement and fearful of legal ramification the BOARD STOPS all vetting, no approval procedure required! Lester the Molester purchases a home and moves in. Years go by without incident. But alas, old dogs return to old tricks. Fortunately Lester is quickly apprehended and convicted, but sadly, the victim is scarred for life. The victim’s attorney files suit against the association, against the LCAM and LCAM firm. The claim is, there was a procedure in place which would have identified Lester and prevented him from moving in so now both parties will spend a tremendous amount of money to defend this lawsuit only to have the insurance carriers settle for some astronomical amount of money.

    

Think this can’t happen? Think again. I’m all for HUD protecting the public, but this seems to be taking it way too far!
