Allowing Homeowners to bring in outside professionals to utilize Association exercise equipment, may not be in the best interest of the Association. What if the Personal Trainer, who is considered a Vendor of the unit owner, gets hurt utilizing a piece of equipment or injures the Homeowner? Let’s say the injury results in the need for medical attention, rehab or permanent disability. With Florida leading the nation in litigation, the likelihood of the Association being named, is extremely high!

 

Several years ago, a personal trainer put an elderly owner on a treadmill, increased the incline and speed beyond the ability of the Homeowner, and the Homeowner was thrown off the treadmill and broke their back! The Association was sued $250K to settle, although the equipment was working properly and was in no way at fault. While this took place in another state, it very well could happen in Florida!

 

Should these service providers be responsible for submitting business licenses and insurance certificates, naming the association as additional insured, to the Association? I SAY YES!
