SHOULD I ENFORCE THE RULES?

Moving into an association comes with many benefits and some drawbacks.  Some of the drawbacks will impact some of the freedoms you had before living in an association. No different than moving into a county or city with specific ordinances.

 

As board members, you have the responsibility to uphold those documents and their rules.  While it can be controversial at times, you shouldn't run away from the problem. You do have to keep in mind allowing certain community members to get away with certain violations only opens the doors for others to do the same.  Further not taking a stance can open you and your board up to more significant issues.

 

The steps that should be taken are following what the association documents outline.  Compliance letters should be sent to those owners who violate any of the rules or covenants. Within that letter you should outline the reason for such a letter and where they can find the section of such breach. 

 

Consistency allows for proper rule enforcement.  If you or your board don't like a particular rule, you can always make changes; however, that may be more challenging than merely enforcing the rules. Remember any changes to your docs or rules you must consult with your attorney for proper guidance.
