VOTING, IT’S A NO WIN SITUATION

Recently my firm had the privilege of assisting with the annual election at a large luxury high-rise in south Florida. Legal counsel was present and conducted the entire process from beginning to end. However, the outcome was not what many of the owners expected, nor wanted. But, it was what the majority voted for. It’s unfortunate that owners and board members often don’t truly understand what it takes to successfully serve as an effective board member. You don’t have to like the board, and they don’t have to like every homeowner. BUT, each must always show respect for the other. In every election, there are winners and losers. But if everyone works together towards common goals, the association and homeowners benefit! Below are a few key items that owners and boards should keep in mind.

  1. The majority of the owners put the board members in charge!

  2. A house divided amongst itself cannot stand (The board must be unified in all actions and decisions.

  3. Homeowners will not respect the board if they do not provide consistent communication, transparency for all decisions, refrain from involvement in normal daily management issues, fail to see that tasks are completed expeditiously and refrain from serving personal agendas. And lastly, failing to respect every homeowner.

  4. Homeowners must understand that the majority of owners placed this board in charge, and therefore, while they might not agree with their decision as leaders, they must be supported and respected.

My last comment on this is that it is a two way street. Both parties have to be committed to the common goals to succeed.
