DON’T LOOK TO YOUR CAM FOR MEDIATION

Arbitration/Mediation is without a doubt a great resource for conflict resolution. Unfortunately, far too often their CAM ’s who obviously are qualified to provide them answers or recommendations. As property management, we firmly believe in closely monitoring legal expenses and minimizing them as much as possible. BUT we are not attorneys and should never put ourselves in the position of providing such advice to our Boards. So what type of questions should the Board feel comfortable in asking their CAM ?

  1. Should legal action be taken for a delinquent Homeowner?

  2. Should we seek legal advice regarding this matter?

  3. What do the Association documents say?

What should they not ask?

  1. Should we sue the Developer?

  2. Should we sue the Homeowner?

  3. Can we take action outside of our Declaration and State Statute?

  4. Do we have a case against this Contractor?

  The CAM should ALWAYS answer this question with, “That requires a legal opinion and we should consult with the Association Attorney and let them handle it!”
