TAKING LEGAL ACTION AGAINST YOUR ASSOCIATION

There are certainly times when unethical Boards need to suffer the consequences of their inappropriate actions. But what about those individuals who continually file frivolous complaints with the courts and DBPR simply because they have nothing better to do. In North Florida, a condominium association is experiencing just that. A Homeowner who is unhappy with their home purchase has filed numerous complaints with the DPBR only to have them dismissed. There have been numerous hearings with the courts and arbitrators all being dismissed. The impact to the Association has been tremendous due to the constant need to retain legal counsel and the involvement of the Association insurance company. The cost of D&D insurance has increased from $1500 annually to $50,000 annually and legal expenses have exceeded $40,000. So what does the unhappy homeowner want? They want the Association to purchase their unit from them at the same price they paid for it in 2004. I bet there are many people who would like to get what the originally paid for their unit! Homeowners should realize the negative impact they can have on their Associations as a whole when taking legal action. Do you have Homeowner like this? How does your Board handle it?
