OUR DOCUMENTS ARE OUTDATED!

With so many condominiums and homeowner associations in Florida, and the regulations always changing, how can the board ensure that their documents stay up to date? If you’re lucky enough to have the Kaufman Language, “as amended from time to time” verbiage in your current documents, you are pretty much covered. As Eric stated, this language ensures that your association must comply with all regulations, as they come about.

  

For those of you whose documents don’t contain this language, now is a great time to review your entire document package, and add the “Kaufman language”, and update all other items that may be outdated. I suggest putting together a committee, for the purpose of reviewing and suggesting revisions, prior to hiring an attorney to walk you through the amendment process. By doing so, it is not only a money saving exercise, but will also get owner input and involvement.

  

Every association goes through a transitional period through the years. Ensuring that your documents are up to date is a normal course of action. Also, don’t forget to attend an annual board meeting certification seminar, taught by Eric Glazer. This is also a great way to stay informed.
