CLEARING UP ELECTION CONFUSION AND MAYHEM

I could not agree more, that election time is the most volatile time for an association. Every homeowner, board member and CAM think they know exactly how it should be done. The problem is, in many cases, THEY DON’T!

  

Many of you know, that I view a lot of the state statutes ridiculous. Like the one that say if a CAM is determining a quorum, it is practicing law. BUT, given the nuances and regimented procedures required for the election process, I firmly believe, that having an attorney present and allowing them to lead procedures, can eliminate a tremendous amount of confusion along with the owner mayhem that can follow.

 

But beware, the outgoing board needs to ensure they retain an attorney who has experience in performing elections, has reviewed the community documents and is well versed on the overall temperature of the homeowners. They must possess the demeanor to diffuse any and all confrontational situations. Having the attorney walk the owners through the process, prior to beginning, is a great way to ensure everyone understands what to expect.
