There seems to be no end in sight of the continuous stories of fraud and theft of association funds, illegal elections and other mismanagement. This seems to be most common in south Florida. And though it is true that condo associations can utilize the DBPR to assist in investigating and resolving claims of illegal activity, the homeowners associations have little to no recourse.

 

First and foremost, homeowner associations must join forces and force legislators to add their oversight to the responsibility of the DBPR. Things will not, and cannot change until homeowners join forces and push for equal representation. But it can’t stop there. One of the most common problems we see, are homeowners who suspect, or even have proof, that the Board is taking illegal action or misappropriating funds. These owners are very vocal and confrontational, but simply don’t want to take the time to file a complaint or work to recall the board.

   

Having the DPBR as oversight is a great asset, but the initial oversight has to start with you the owners! You must set the standards for your board and hold them accountable.
