Often times, we as managers, feel the frustration of our board who review their docs, only to determine there is so much grey area or they simply don’t understand the legalese. This can, and does, result in boards taken actions which are in direct conflict with the intent of the docs. Many boards believe as long as they are acting on their interpretation of the wording, then it is okay to move forward. The truth is, most board members can’t make heads or tails from the association documents or how they relate to Florida Statute 718 or 720. Adding to the problem, many boards seek direction from their CAM or CAM Firm only to be misled. Recently we took over a community from the largest management firm in South Florida. We found out that the developer deficit funding period ended in 2012, and that the manager had informed the board, that they simply needed to vote to extend deficit funding indefinitely! Of course, the majority of the board is controlled by developer representatives. So for the past 5 years, the developer has not paid fees for all of his unsold units!

  

Board members and developers should be required to attend a certification class and in my opinion a legal seminar on when to seek counsel on the interpretation of the association Docs. Many errors could be prevented if those were required.
