SHORT TERM RENTALS, A NATIONWIDE PROBLEM

AIRBNB, VRBO, FlipKey and HomeAway are just a few of the companies who will rent your home out for a daily rate. These companies have shown, they could care less if your association documents have restrictions prohibiting short term rentals. As a result, many states are going to extremes in an attempt to mitigate the outcry from such rentals.

 

One example is Nashville, Tennessee. Nashville has become a popular destination for music lovers and musicians of all genres! With a lack of available hotel rooms, VRBO and AIRBNB have become an extremely popular means for renting accommodations. The city passed an ordinance that all unit owners wishing to rent their condo must apply and obtain a permit from the city. What they now have come to realize is that this simply opened the flood gates, for short term rentals, and made unit owners believe it was okay no matter what their documents stated.  The rentals have caused a number of lawsuits between unit owners and boards, heated disagreements between owners and calls to law enforcement are up 23% due to drunk and disorderly behavior of the “renters”. It has also been reported that several break-ins, property damage and sexual assaults have also occurred.

 

Clearly, no matter what state this happens in, it is going to take some legislation with teeth, to get it under control. Amending your documents just might not be enough!
