HOW FAR WILL SOMEONE GO TO BEAT THE SYSTEM?

According to the Americans with Disabilities Act (ADA) 2010 regulations, the definition of a service animal is “Any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability”; including physical, sensory, psychiatric, and intellectual or other mental disability. “Other species of animals, whether wild or domestic, trained or untrained, are NOT service animals for the purpose of this definition”. C.F.R. § 35.104 and § 36.104. If they meet this definition, dogs are considered service animals under ADA, regardless of whether they have been licensed or certified by a state or local government.

 

Here is my hypothetical scenario, just for fun…

  • Bob Boozer, lives at Capital Condominiums which is a pet free community. Bob is an alcoholic and is considered to have a disability. Bob has trained his Irish Setter, to fetch beer from the fridge and dispose of the empty beer cans in the trash! The association demands Bob remove his dog from the “No Pet Community”, to which Bob responds, I am disabled, due to my alcoholism. I have trained my dog to assist me, therefore he is not only my service dog but also my emotional support animal!

  • First let me say, I mean no offense. Alcoholism is a very serious disease. My point is, until such time legislation with teeth, is put in place regarding the requirements for service animals and support animals, the arguments will simply become crazier!
