Removing
someone’s property may be going too far, but what do the
bylaws state? Maybe a “fine” would be more appropriate.
I’m reminded of an incident which occurred in Jenson Beach
several years ago.After
turnover from the Developer, the new Board was determined to
make a difference. One of their hot buttons was the
“illegal” parking of commercial vehicles on property.Following proper guidelines and Bylaws, notices were sent
to all offenders stating that should they continue violating the
bylaws, their vehicle would be towed without further notice. No
vehicles were to be exempt. Believe it or not, the Board
INCLUDED A MARKED POLICE PATROL VEHICLE AS AN OFFENDER!
As
you can guess, many Homeowners like having a visible law
enforcement vehicle on the premises as they believe it to be a
“crime deterrent”! The Board stood firm in their decision to
include all commercial vehicles, including the police car.
Homeowners became enraged and like the Board, followed the
protocol set forth in the community Bylaws. They called for a
special meeting, recalled the entire Board and amended the
documents to specifically exclude Law Enforcement vehicles.
