Like
Eric, as CAM's we are often approached by Board Members or
Homeowners who want to place racially motivated restrictions on
their community. Likewise, our response is, "We do not
discriminate, we adhere to ALL Fair Housing and ADA
Regulations." We further advise, that theses inappropriate
conversations or comments are a liability to the Association and
should cease immediately!
Believe
it or not, the most common response is, "What did I
say?" This brought me to the realization that many
lay-persons do not know who's protected, who's not and how
simple comments can be construed as discriminatory.
The
Fair Housing Act of 1968 clearly states the following, also
known as Title VIII of the Civil Rights Act of 1968; "The
act was passed in an effort to impose a comprehensive solution
to the problem of unlawful discrimination based on the
following: race, color, sex, national origin, religion, family
status and handicap."
Recently,
the Board of a luxury high rise community, held conversations
with a potential buyer, who was wheelchair bound, suggesting
that him moving into the building was a bad idea because, "What
if the elevators were down in a fire and he was unable to get
down the stairwells?". Do I personally believe the Board
was acting discriminatory? No, I believe they were concerned for
the welfare of the individual. However, could they be sued for
discrimination? Absolutely, and likely to be found guilty!
It is cases like these that you must keep your opinions
to yourself and let the individual deal with the potential
hardships on their own.
