FLORIDA GETS IT RIGHT

As a licensed Broker in a number of states, as well as managing Associations throughout the southeast, I have to say for all the complaining we hear about the lack of regulation for HOA’s, Florida absolutely gets it right for regulating condominiums. Okay, well, 99% right! The extensive regulations set forth in FS-718 can easily answer every question a Board Homeowner or LCAM could have. The state seems to have gone to great lengths to ensure the professional operation of COA’s and to protect the condominium unit owner’s rights. While we are seeing states such as Georgia, Tennessee and South Carolina working to enhance their regulations, they have a long way to go and could, and should, consider using FS-718 as a template for implementing their own statues. That being said, you may notice that I only gave Florida a 99% grade. The one area where I believe there is “OVERKILL” would be the “election process”. Surely there could be a more simple way of casting your vote via an envelope, inside an envelope, inside another envelope!
