Many times we see Boards, both HOA’s and Condo’s, attempting to regulate situations far beyond their realm of responsibility.

 

Over the past 13 years, I have seen Boards attempt to regulate the length of stay by a guest. When does a guest become an occupant?

 

We have seen Boards attempt to regulate the makeup of a family unit. How can a gay couple, that adopt a child, be a family?

 

We have seen Boards try to dictate live in health care workers for the elderly. They are employees, not family!

 

Believe it or not, we are now seeing Homeowners deed 1% ownership of their unit to a renter, so that they are able to side step leasing limits and occupancy regulations.

 

As a Management Firm, we are obligated to work with our Board to ensure that declaration documents and bylaws are complied with. However, neither the LCAM nor the Board should attempt to make legal determination of what constitutes a family unit or guest.

 

Legal Counsel should always be consulted before any action is taken to protect the Association from litigation.

 

But most of all, Boards and LCAM’s should use common sense as opposed to personal opinions!
