Bad neighbor stories are plentiful and as CAM ’s, we appreciate the Board having the authority to regulate who resides within a community.

 

After 20 years managing apartments, those pitfalls are still so fresh the memories make me less than anxious to deal with unruly renters again!

 

In order to be proactive in the rules established by the Board, and to avoid future potential pitfalls, here are the guidelines we always present to our Boards.

 

1.   Review your Association documents and bylaws with regards to selling or leasing a unit, what restrictions have they placed on your homeowners?

 

2.   Consult with the Association attorney. Get a clear understanding of what is enforceable within Fair Housing and ADA compliance.

 

3.   Establish your criteria along with your attorney and use these “Qualifying Standards” for everyone without exception. Remember, an exception can lead to a discrimination lawsuit.

 

4.   Do your research. There are firms who will perform background investigations and credit reports and utilize the established criteria for your association, approve or deny the applicant.  Using a third party takes much of the liability off the Board. Many Associations pass this cost along to the applicant!

 

5.  Establish criteria that are reasonable. No you cannot reject

     someone because they cook with curry, because they

     dress differently or even look different.

Never implement procedures that your attorney has not blessed because in this case they do know best!
