Over the past few years we have seen many communities aggressively attempt to manage their percentages of leased units. Boards have come up with all sorts of guidelines, rules and regulations to monitor. Such as, who is a renter, who is a family occupant and who is an owner?

 

The most recent hurdle to overcome is the invasion of the VRBO or Vacation Rental by Owner. Most Declarants and Bylaws specify that only 12 month leases may be offered by investors to potential renters within a community. However, in a number of markets such as Miami , Orlando , Key West and Ft. Lauderdale , unit owners are advertising their homes on these sites and renting by the day, week or month.

 

In an effort to stop the constant influx of strangers to a community, many Boards have taken drastic measures and implemented aggressive fines to stop this trend. In those communities, with security or concierge staff, some Boards even instructed the staff to refuse admittance to these unsuspecting short term renters.
