Open for Interpretation

Reading and understanding your community bylaws is without a doubt the most important action a prospective Board Member can undertake once they have decided to run for office. However, keeping in mind these are legal documents, most of us don’t speak the legal language, and many Board members and CAM’s will apply their own interpretation which may or may not be correct.

  

Believe it or not, this happens frequently, especially in HOA's as the regulations and bylaws are so vague. Case in point, the bylaws of a condominium community in Orlando stated the window and maintenance of the windows were the responsibility of the Association. Two of the five board members interpreted this to include the inside "window sills" and therefore issued a violation to the owner who had plants or knick knacks placed on the inside window sill, as they believe it might cause damage.

  

As you can imagine there was an outcry from the Homeowner, which escalated to the involvement of the Associations Legal Counsel, who quickly informed the Board that their interpretation was incorrect!

  

Consider making a list of areas that you may find unclear and seek clarification on those issues.
