ANOTHER HALF BAKED DECISION

If you listened to the Condo Craze and HOA’s broadcast on Sunday July 20^th, you know I have a very strong opinion about the ruling stating, “Emails are not official Association records”. This line of thinking is as baffling to me as is the Legislators insisting to treat HOA’s and COA’s differently. Because they are basically the same and should be regulated by the same statutes, all communication between Board Members regarding affairs and operations of the Association should be considered “Official Records”.

If an email is sent to all Board Members discussing Association business, then isn’t this a quorum and shouldn’t it be properly noticed? How many Boards will use this as a way to make decisions without Homeowner input and then simply ratify these decisions at the next meeting? Doesn’t this law simply open up an avenue for misbehavior?
