The
right to vote is a privilege most Americans treasure. I also
agree there should be some sort of due process before losing
that privilege. But, over regulating the loss of voting
privileges for Associations would merely open the door for more
confusion and chaos.
Convicted
felons lose their right to vote in America and I personally
believe that when a Homeowner purchases a home in an
Association, they are making a conscious decision and financial
commitment to all of the other Homeowners to fulfill their
fiduciary responsibility so that the community can meet its
financial obligations. Failing to fulfill their obligation and
pay their fees on time affects the entire community and property
values of everyone. Therefore, it is my opinion that the Board
or Management Firm should have the right to take all necessary
action, even embarrassment, to collect delinquent fees.
However,
both the Board and Management must have a comprehensive protocol
in place so that the reported delinquency has been verified
prior to taking in adverse actions in order to reduce potential
liability.
