When preparing for my Georgia Brokers license test, the instructors drilled into me, that as a Real Estate Professional, we would often be asked for an opinion or advice which bordered on “legal advice”. Our response was always to be “You really should seek legal counsel. I’m not an attorney and I’m not qualified to advise you on this matter.“ Over the course of ten weeks, I’m sure I heard this at least a hundred times. However, being in a service provider industry, my mindset has always been to be as helpful as possible! Over the years I’ve developed a slightly different approach. Oh, I still refrain from doing anything that might be construed as “practicing law” but I do try to go the extra mile and assist everyone in achieving resolution to their requests or questions. Let’s use Eric’s example of #7, violating any provision of chapter 718, chapter 719 or chapter 720 during the course of performing Community Association Management Services pursuant to a contract with a community Association as defined in
FS
468.431(1).
First and foremost, all CAMs should maintain updated knowledge of changes in the Florida statutes by continually attending continuing education classes such as the one Eric has recently had approved by the DPBR. In utilizing this information the CAM should recommend ways the Board may accomplish their goals without causing the licensee to risk their licenses. By carefully explaining the regulation to the Board along with the ramification of taking certain actions and suggesting alternative solutions may achieve the Boards’ goal and keep the CAM out of trouble. If the request cannot be accomplished then the answer is simply NO and explain why. Most Boards will understand.
