WHAT GETS ME FRUSTRATED

I thought long and hard before writing this blog. I don’t want
any of my readers or fans of the radio show or attendees of my
seminars to take what I’m about to say as being either mean or
personal because it certainly is not meant to be. So here
goes……………
SOMETIMES YOUR QUESTIONS AGGRAVATE ME!
There, I said it and I said it for your own good. Let me
explain. Sometimes you will tell me about how your community
association manager told you that the law is to be interpreted a
certain way that is clearly incorrect. Sometimes you will tell
me about how your condominium or HOA attorney really doesn’t
that this kind of law, but they were recommended by the
management company, “so Eric, if you wouldn’t mind just
clarifying something for us.”
I will answer your question each and every time, but then I
wonder what in the world is going on in your community and why
you continually allow it to happen.
No matter how many times I teach about the fact that the manager
should not and cannot interpret the statutes and your governing
documents, you always seem to listen to what the manager has to
say in this regard. Then, you don’t bother getting a legal
opinion from counsel because the manager actually chose the
attorney, not the Board. The attorney is not well versed in
this area anyway and you don’t want to spend money on attorney’s
fees to get an answer you may not trust.
So, I sit there and I answer your question, and then you walk
away leaving your present condition intact. And I think to
myself that the members of this Board don’t have an attorney
that they work with and are asking me questions that their own
attorney should be answering for them. When you tell me you
don’t like your management company and I ask to see their
contract, you usually show me a contract for three years or more
with no possibility of cancelation. So then I wonder again, who
told them to sign this god forsaken document?
So again, don’t get me wrong, I love answering your questions.
But here’s one for you: Why do you continuously let your
association get beat up?
