CHEATING WITH ELECTIONS?

Both Florida Condo
and HOA statutes eliminate the voting rights of an owner who is
more than 90 days delinquent on any payments owed to the
association. And on top of that: The owner is unable to be a
candidate for an election of the board.
Dictatorial board
members in HOAs have figured out this loophole and create
quickly fines for possible opposing unwanted candidates, timely
to force the owner either to pay the ”invented” fine or being
eliminated as a candidate for the board.
Well, would you pay
$1000.00 just to be able to be a candidate at the next board
election? I don’t think so – and the dictatorial board reached
its goal – no opposing unwanted candidate at the election. After
the election is over and the dictatorial board is back in power,
they will just quickly delete the fine since they know full well
that this so-called “fine” wouldn’t make it through litigation.
Even if the idea
behind the “delinquent payment” punishment made sense, it
created a loophole with unintended consequences and makes
election “fraud” possible. Don’t we already have enough
ELECTION FRAUD in our nation?

We think that only owners can really represent owners, since all
service providers surely have a different interest! We are
trying to create owner-friendly laws, but the best laws are
useless without enforcement. And enforcement is totally lacking
in
Florida
!
