And you can only get knowledge through
EDUCATION. That’s why it is really important that
Senate Bill SB 394 [Senator Ana Maria Rodriguez (R-Distr.
39)] and
House Bill HB 547 [State Representative David
Borrero (R-Distr. 105) will end up on the desk of Governor Ron
DeSantis for his signature.
That would finally end the game of
certain board members who in the past just signed a “stupid”
form stating that they know it all.
Owners in community associations
should be able to minimum rely on the fact that their board
members, who have the power to destroy their personal finances,
gain some sort of education before they start working as board
members.
Board members shouldn’t be able to
claim that they acted in good faith when they state that they
acted in “good faith” when violating the Florida
statutes – using the Business Judgment Rule as an excuse for any
wrongdoing.

We think that only owners can really represent owners, since all
service providers surely have a different interest! We are
trying to create owner-friendly laws, but the best laws are
useless without enforcement. And enforcement is totally lacking
in
Florida
!
