COVID
RESTRICTIONS

There has been a great
deal of hesitation by some associations to reopen amenities such as
pools, gyms, parks, and clubhouses. Part of the hesitation had to do
with the risk of liability from a legal claim that the association
was somehow responsible for someone contracting COVID19.
Based on the two
recently signed executive orders by Gov. DeSantis, the association
is not under an obligation from any state or local order requiring
it to maintain/communicate/supervise that some/certain safety
standards such as regular sanitation, sanitation stations, visible
signage to maintain social distance and wear masks, taking
temperature, capacity use restrictions, etc. However, it is
recommended that the association still be proactive in doing this to
the extent practical because it would want to be able to show that
it still implemented reasonable practices (without being overly
restrictive) to preserve the health and safety of its residents as
much as possible.
If
the association opens up all amenities with no restrictions but is
active in reminding residents that they assume the risk of
contracting COVID-19 by choosing to access and use shared facilities
and encourages residents to maintain social distancing where
possible, wear masks around other people where possible, stay home
if they’re feeling ill (even if none of these are requirements),
post-CDC signage throughout the facilities reminding residents to
wash their hands, etc., then that would go a long way towards
minimizing any potential liability exposure for the association.
