Associations are looking to get back
into the swing of normal operations, and that may mean pushing hard
to finish long-delayed projects. Certainly, there is no time like
the present to improve the community and quality of life for
residents. However, the board should rely on its management team and
attorney to determine the best approach to executing the projects.
The management team should be
assisting the board in determining if an engineer is required,
drafting a scope of work, establishing payment structure,
establishing the performance expectations, which include project
dates/timelines and adherence to the scope of work. The management
team can also conduct the budding process and evaluate each bid to
provide a bid comparison and provide a professional opinion.
Finally, some due diligence should be done to review licenses,
references, warranties, and insurance.
The association’s attorney can be
instrumental in reviewing the contract involved and ensuring the
association is protected. Some of these areas include having clear
timelines with consequences for the project, clearly designating who
is responsible for permits, how often the contractor will submit
reports and be present at board meetings for a project update, how
to handle change orders, or new work being requested, insurance and
safety requirements, and liability for any worksite injuries or
damages.
While there is more than the manager and attorney can do in this
process, I think the idea here is that the board should seek the
professional help of the management team and attorney and allow them
to do their best work for the association
