PRO’S AND CON’S OF TERM LIMITS

When I first heard of the law's change, I wondered if this is the right thing for our communities? Like anything I'm uncertain of, I created a Pro's and Con's list, which I've listed below.  

 

Pros 

  1. Because of the term limits, you may have more openness or get more people involved. 

  2. If you have a dictator sitting on a board, you now have a tool to replace them. 

  3. If you've had the same board that doesn't progress the association, you now have the means to replace them. 

Cons 

  1. The loss of knowledge from a board member on projects that have occurred, why certain decisions were made, etc. 

  2. Losing someone honest, trustworthy, and that truly cares about the association and its business. 

Having term limits, in my opinion, is an excellent thing because it keeps things honest. While it comes with its challenges, the change in guard allows for fresh ideas and strategies to be applied, no different than our government. Fortunately, the law does allow great Board Members to remain in their seats. It does take a large vote or not interest of running; however, the possibility does exist.

 

I would like to see a similar law for HOA's because in certain HOA's the quorum requirement to have a valid election is too high, allowing many boards never to change.
