AMENDMENT STEP BY STEP

The Board of Directors is tasked with many responsibilities, one of them enforcing the rules within their community documents. In some cases, community documents are open-ended, unclear, outdated, or they don't have the language needed to enforce a problem they have. So what do you do if you don't have Kaufman language in your documents?  

  1. Contact your association attorney to understand what steps you must take to amend your documents. 

  2. Review your documents and put together a list of items you would like to add/remove from your association's documents based on current and prior challenges within the association. 

  3. Present all the changes to all board members to discuss and internally approve to present to the attorney.   

  4. Presentation - Some boards decided to present one complete change of the documents, while others break down the vote per change or group them strategically. 

  5. Review - Have the attorney review all your recommended changes and/or additions; further, I would recommend you have the attorney prepare the notices as well. 

  6. Voting - To make the process easier, contact an online voting vendor. Giving owners quick access to voting allows for a higher probability of getting the votes you need to make the change.

  7. Host the necessary meeting for the vote. 

 

Amending associations can seem daunting; however, if you have a process and technology in place, you have a higher chance you will be able to accomplish the task.
